1. LEGAL INFORMATION

  • 1.1  AFDA, Blaby and Whetstone FC, Warwick Road, Whetstone, Leicester, LE8 6LW (the “Academy”) is a Further Education Institution engaged in providing facilities, football and education opportunities for all of its students.
  • 1.2  The Academy (referred to as “Data Controller”, “we”, “us” or “our”, as appropriate) will act as an independent Data Controller with regard to the processing of our members (“you” or “your”) Personal Data (as defined in section 2.1 below) for the purposes detailed in section 3.
  • 1.3 The privacy of your Personal Data is of the upmost importance to us. This Privacy Notice covers and is designed to help you understand how we process the information that we collect about you or that you provide to us.
     2. COLLECTION OF INFORMATION

    2.1 We collect personal data, which under applicable data protection legislation, includes information that can be used to identify you, including, but not limited to, your first and last name, address, phone number, email address, date of birth, occupation, employer, your football and education history, your disabilities and pictures of yourself (“Personal Data”). We will also collect sensitive personal data including but not limited to information regarding your ethnicity and your health information (“Sensitive Personal Data”).

    2.2 We may collect your Personal Data and Sensitive Personal Data that you provide when you interact with us, complete an enrolment form, participate in any of our organised events, activities or lectures or correspond with us in relation to the running of the Academy.

    3. USE OF PERSONAL DATA

    1. 3.1  We will only use your Personal Data to enrol you onto the course with our funding provider, to register you in any football leagues, for use in the Academy’s marketing material and to correspond with you.
    2. 3.2  We will process your Personal Data where you have given us your consent, where it is necessary to comply with our legal obligations or where it is necessary for the Academy’s legitimate interests. The Academy’s legitimate interests include the effective and efficient running of the Academy.
    3. 3.3  The Academy may use your Sensitive Personal Data for reporting reasons and where necessary to ensure that you receive the necessary medical treatment.
    4. 3.4  We will process your Sensitive Personal Data where you have given us your consent or where it is necessary for medical reasons.
    5. 3.5  The Academy may also use your Personal Data for marketing purposes, as described under section 7 below, subject to obtaining your prior consent where necessary.

    4. SHARING OF PERSONAL DATA

    4.1 We may share your Personal Data when authorised by law or as follows:

    1. (a)  The Football Association (FA) or English College Football League (ECFL). Your Personal Data may be passed onto the Football Association or any of the football leagues for monitoring or league administration purposes.
    2. (b)  Third party or affiliated service providers. Your Personal Data may also be processed by service providers, including companies that we use to assist us in running the Academy. These service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any purpose other than to facilitate the specific outsourced related operation, unless you have explicitly agreed or given your prior permission to them for additional uses.
    3. (c)  As permitted or required by law. From time to time, we may be required to provide Personal Data in response to a valid court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful or in violation of applicable laws. We may release certain Personal Data when we believe that such release is reasonably necessary to protect the rights, property, and safety of others and ourselves, or to detect, prevent, or otherwise address fraud, security, or technical issues.
    4. (d)  Sponsors. Sometimes we may pass on your Personal Data to our sponsors where it is part of any sponsorship contract provided that you have provided your consent in accordance with section 7 below.

    5. YOUR PRIVACY RIGHTS

    You have several privacy rights in accordance with the data protection laws applicable to you. If you reside in the EU, you have the right to; access to your

    Personal Data processed by us; correct it, delete it, limit/restrict the processing of your Personal Data that can be performed by us; you have the right to transmit your Personal Data and the right to be notified about any possible data breaches, where the safety of your Personal Data, your right to confidentiality and personal data protection may be put at risk. In order to exercise your rights you can contact us at info@afdaleicester.co.uk. You can also lodge a complaint with the Information Commissioners Office if you wish. We may not be able to accommodate every request related to certain information, if we believe this would violate any law or other legal requirement, or other data subjects’ rights.

    1. RETENTION OF PERSONAL DATA

      We will retain your Personal Data for as long as you are a member of the Academy. We will also retain your Personal Data as necessary to comply with our legal obligations resolve disputes, and enforce our rights. We will delete your Personal Data upon your request, in accordance with the data protection laws applicable to you.

    2. COMMERCIAL ELECTRONIC COMMUNICATIONS
    1. 7.1  The Academy will be entity entitled to send you promotional emails and other marketing electronic communications on the basis of the provision of your specific consent to marketing activities. You can always limit the communications that the Academy sends to you by replying to an email with the words “unsubscribe” and you will be removed from the Academy’s marketing mailing list.
    2. 7.2  Please note that even if you opt-out of future promotional emails, we may still need to contact you with important information about your membership, in accordance with applicable data protection laws.

      This Privacy Notice only addresses the use and disclosure of information by the Academy. We encourage you to familiarise yourself with the privacy policies provided by all third parties prior to providing them with information.

    2. SECURITY OF PERSONAL DATA

      We will use standard technical and administrative security measures to protect your Personal Data against unauthorized access. However, since the internet is not a 100% secure environment, we cannot warrant, guarantee, or ensure the security of any information you transmit to us. There is no guarantee that the information may not be accessed, disclosed, altered, or destroyed by a breach of our physical, technical, or administrative safeguards.

    3. CHANGE OF PRIVACY NOTICE

      Our Privacy Notice may change from time to time. We will not reduce your rights under this Privacy Notice without your explicit consent. We will post any Privacy Notice changes on our website and, if the changes are significant, we will provide a more prominent notice.
